{"id":547,"date":"2023-05-25T15:02:48","date_gmt":"2023-05-25T19:02:48","guid":{"rendered":"https:\/\/consfiladelfia.esteri.it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/cittadinanza\/riacquisto-di-cittadinanza\/"},"modified":"2025-06-27T12:52:44","modified_gmt":"2025-06-27T16:52:44","slug":"riacquisto-di-cittadinanza","status":"publish","type":"page","link":"https:\/\/consfiladelfia.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/cittadinanza\/riacquisto-di-cittadinanza\/","title":{"rendered":"Reacquisition of Citizenship"},"content":{"rendered":"<p><strong>Re-acquisition of lost Italian citizeship<\/strong><\/p>\n<p><strong>Law No. 74 of May 23, 2025<\/strong>, converting Decree Law 36\/2025, amended\u00a0<strong>Article 17, paragraph 1, of Law No. 91\/1992<\/strong>, allowing former Italian citizens, including those residing abroad, in certain cases and for a limited time period, to\u00a0<strong>reacquire Italian citizenship by submitting a declaration<\/strong>.<\/p>\n<p>The\u00a0<strong>new Article 17, paragraph 1, of Law No. 91\/1992<\/strong>\u00a0applies when the following requirements are met:<\/p>\n<ol>\n<li>The applicant must have been\u00a0<strong>born in Italy<\/strong>or have been\u00a0<strong>resident in Italy for at least two consecutive years<\/strong>;<\/li>\n<li>The applicant must have\u00a0<strong>lost Italian citizenship no later than August 15, 1992<\/strong>, in one of the following cases:\n<ul>\n<li><u>Voluntarily acquired a foreign citizenship no later than August 15, 1992, and established residence abroad<\/u>(<a href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/1912\/06\/30\/012U0555\/sg\">articolo 8, numero 1\u00b0, della legge n. 555\/1912<\/a>);<\/li>\n<li>Having automatically acquired a foreign citizenship (not by their own choice), they\u00a0<u>renounced Italian citizenship and established residence abroad<\/u>(<a href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/1912\/06\/30\/012U0555\/sg\">articolo 8, numero 2\u00b0, della legge n. 555\/1912<\/a>);<\/li>\n<li>Was a minor child (not emancipated) of someone who lost citizenship,\u00a0<u>shared residence with the parent, and acquired the citizenship of a foreign state<\/u>(<a href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/1912\/06\/30\/012U0555\/sg\">articolo 12 della legge n. 555\/1912<\/a>).<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p>The new Article 17, paragraph 1, of Law No. 91\/1992\u00a0<strong><u>does NOT apply to<\/u><\/strong>:<\/p>\n<ul>\n<li>Former citizens\u00a0<u>born abroad who have not resided in Italy for at least two consecutive years<\/u>;<\/li>\n<li>Those who l<u>ost citizenship after August 15, 1992<\/u>\u00a0(for any reason);<\/li>\n<li>Those who lost citizenship under\u00a0<a href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/1912\/06\/30\/012U0555\/sg\">articolo 8, numero 3\u00b0<\/a>\u00a0(i.e., anyone who, \u201chaving accepted employment with a foreign government or entered military service for a foreign power, persisted in such service despite the Italian government\u2019s order to leave such employment or service within a specified time\u201d);<\/li>\n<li><u>Those who did not exercise the option<\/u>\u00a0provided by\u00a0<a href=\"https:\/\/www.gazzettaufficiale.it\/atto\/serie_generale\/caricaDettaglioAtto\/originario?atto.dataPubblicazioneGazzetta=1983-04-26&amp;atto.codiceRedazionale=083U0123&amp;elenco30giorni=false#:~:text=Il%20coniuge%2C%20straniero%20o%20apolide,se%20non%20sussista%20separazione%20legale.\">articolo 5, secondo comma, della legge n. 123\/1983<\/a>\u00a0(a\u00a0<strong>minor child<\/strong>, including adopted, of an Italian father or mother who, in case of dual citizenship, could choose one citizenship within one year of reaching the age of majority).<\/li>\n<\/ul>\n<p><a href=\"https:\/\/consfiladelfia.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/cittadinanza\/riacquisto-di-cittadinanza\/procedure-for-re-acquisition\/\"><u>PROCEDURE FOR RE-ACQUISITION<\/u><\/a><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"Re-acquisition of lost Italian citizeship Law No. 74 of May 23, 2025, converting Decree Law 36\/2025, amended\u00a0Article 17, paragraph 1, of Law No. 91\/1992, allowing former Italian citizens, including those residing abroad, in certain cases and for a limited time period, to\u00a0reacquire Italian citizenship by submitting a declaration.
